TERMS & CONDITIONS OF ENROLMENT, BOOKING AND PARTICIPATION

Please read these Terms and Conditions carefully before booking classes, courses, workshops, private lessons, examinations, performances, events, or purchasing any products from Brighton Ballet School.

By completing a booking through our website, WooCommerce checkout, telephone, email, or any other booking method, you agree to be bound by these Terms and Conditions.

1. DEFINITIONS

“School”, “we”, “us” or “our” means Brighton Ballet School.

“Student” means any adult participant or child enrolled in classes.

“Parent/Guardian” means the person legally responsible for a Student under the age of 18.

“Customer” means the person making the booking and entering into this contract.

“Services” means classes, courses, workshops, private lessons, examinations, performances, events and any other activities provided by Brighton Ballet School.

“Website” means https://brightonballetschool.co.uk

“Term” means the School’s published academic term.

“Half-Term” means the School’s published half-term period.

2. BOOKING AND CONTRACT FORMATION

All bookings are subject to acceptance by Brighton Ballet School.

A legally binding contract is formed when:

  1. The Customer completes the booking process; and
  2. Brighton Ballet School issues confirmation of the booking.

We reserve the right to refuse or cancel any booking where:

  • a class is full;
  • a technical or pricing error has occurred;
  • the booking breaches these Terms and Conditions;
  • participation may present a risk to the Student or others.

Any payment received for a cancelled booking will be refunded in full.

3. CLASS STRUCTURE AND PAYMENT CYCLES

Adult Classes

Adult classes are sold and paid for on a Half-Term basis.

There are typically six Half-Term periods per academic year.

Children’s Classes

Children’s classes are sold and paid for on a Term basis.

There are typically three Terms per academic year.

Enrolment secures a place for the relevant Half-Term or Term only.

Student Placement

Brighton Ballet School reserves the right to determine the most appropriate class, level, and teacher for any student.

Students may be moved between classes where, in the professional opinion of the Principal or teaching staff, such a move would be beneficial to the student’s development, safety, welfare, or educational progress.

4. FEES AND PAYMENT

All fees must be paid in full in advance.

Places cannot be guaranteed until payment and online booking have been received.

Continuing Adult Students

Fees for the next Half-Term must be paid no later than two weeks before the end of the current Half-Term.

Continuing Children’s Students

Fees for the next Term must be paid no later than two weeks before the end of the current Term.

Payment reminders and notice deadlines will be clearly communicated by email.

Failure to receive or read an email reminder does not remove responsibility for payment or notice requirements.

5. NOTICE OF WITHDRAWAL

Adult Students

Adult Students must provide a minimum of three weeks’ written notice before the end of their current Half-Term if they wish to withdraw from classes.

Children’s Students

Parents or Guardians must provide one full Half-Term’s written notice (being notice received before the published notice deadline for the current Half-Term) before withdrawing a child from classes.

Failure to Give Notice

If the required notice is not received by the applicable deadline:

  • fees for the next payment period remain payable in full;
  • the Customer remains liable for all outstanding fees;
  • non-attendance does not remove liability for payment.

If you are uncertain whether you wish to continue, you are strongly advised to provide notice before the deadline. Notice may always be withdrawn later if you decide to continue.

6. LATE PAYMENT CHARGES

Any fees not paid by the published payment deadline will incur a late payment administration charge of:

£10 per week

for each week or part week that payment remains outstanding.

Brighton Ballet School reserves the right to:

  • suspend attendance;
  • refuse entry to classes;
  • recover unpaid fees;
  • withdraw a student’s place;

until all outstanding amounts have been settled.

Brighton Ballet School further reserves the right to recover any reasonable costs incurred in pursuing unpaid fees, including debt recovery costs and legal fees where permitted by law.

7. CANCELLATION RIGHTS

Where bookings are made online, by email, telephone, or other distance-selling methods, Customers may have rights under the Consumer Contracts Regulations 2013.

You may cancel within 14 days of booking unless:

  • the course has already commenced;
  • you have requested services to begin within the cancellation period.

If classes begin during the cancellation period, any refund may be reduced to reflect the proportion of services already provided.

Any refund payable during the statutory cancellation period will be calculated in accordance with applicable consumer legislation and may be reduced to reflect services already provided.

8. REFUNDS

Except where required by law:

No refunds, credits, transfers, substitutions, extensions, or make-up classes will be provided once a course, Half-Term, Term, workshop, event, examination, private lesson, or other service has commenced.

Refunds will not be given for:

  • illness;
  • injury;
  • holidays;
  • school trips;
  • examinations;
  • work commitments;
  • family commitments;
  • relocation;
  • transport difficulties;
  • withdrawal after commencement;
  • missed classes for any reason.

Any exception remains entirely at the discretion of the Principal.

9. MISSED CLASSES

Students are not entitled to replacement classes, refunds, credits, or fee reductions for missed sessions.

Any make-up classes offered are entirely discretionary and may be withdrawn at any time.

10. HEALTH, MEDICAL CONDITIONS AND FITNESS TO PARTICIPATE

Dance is a physical activity and carries inherent risks.

These risks may include:

  • slips;
  • trips;
  • falls;
  • sprains;
  • strains;
  • muscular injuries;
  • impact injuries;
  • aggravation of existing medical conditions.

By enrolling, Customers confirm that they or their child:

  • are physically capable of participating;
  • have sought appropriate medical advice where necessary;
  • have disclosed all relevant medical conditions, injuries, disabilities, allergies, learning needs, behavioural needs, and additional support requirements.

Customers must notify Brighton Ballet School immediately of any change in medical circumstances.

11. ASSUMPTION OF RISK

Participation in classes is undertaken voluntarily.

Students participate entirely at their own risk.

To the fullest extent permitted by law, Brighton Ballet School accepts no liability for injuries arising from the ordinary risks associated with dance training except where caused directly by proven negligence on the part of Brighton Ballet School.

Nothing in these Terms excludes liability for:

  • death or personal injury caused by negligence;
  • fraud;
  • any liability that cannot legally be excluded.

12. EMERGENCY MEDICAL CONSENT

By enrolling a Student, Parents, Guardians and Students authorise Brighton Ballet School to:

  • administer basic first aid;
  • seek emergency medical treatment;
  • contact emergency services;
  • arrange transportation for emergency treatment where required;

when a Parent, Guardian, or emergency contact cannot be reached immediately.

Any medical costs remain the responsibility of the Parent, Guardian, or Student.

13. PHYSICAL CONTACT IN TEACHING

Dance instruction may involve physical corrections or guidance to assist safe technique, posture, alignment, and learning.

By enrolling, Students and Parents/Guardians consent to appropriate physical contact for teaching purposes.

Consent may be withdrawn at any time by written notice.

14. SAFEGUARDING

Brighton Ballet School is committed to safeguarding and promoting the welfare of children and vulnerable adults.

All staff and regular volunteers working with Students will hold appropriate Enhanced DBS checks and safeguarding training where required.

Brighton Ballet School maintains safeguarding procedures in accordance with current UK legislation and recognised best practice.

Safeguarding concerns may be referred to:

  • Children’s Services;
  • the Police;
  • Health Services;
  • Safeguarding Partnerships;

where necessary to protect a child or vulnerable person.

Safeguarding obligations override normal expectations of confidentiality.

All Customers agree to comply with the School’s Safeguarding Policy.

15. RESPONSIBILITY FOR CHILDREN

Parents and Guardians remain responsible for children:

  • before their scheduled class begins;
  • immediately after their class ends.

Brighton Ballet School accepts responsibility only during the scheduled class period.

Children under 13 years of age must be collected by a Parent, Guardian, or authorised adult.

Students aged 13–15 may leave unaccompanied only where written parental permission has been provided.

Late Collection

Where a child is not collected within 15 minutes of class ending and no contact can be made with the Parent or Guardian, Brighton Ballet School may contact emergency contacts or appropriate safeguarding authorities.

Persistent late collection may result in withdrawal of the student’s place.

16. CONDUCT AND BEHAVIOUR

Students, Parents, Guardians, and visitors must behave respectfully at all times.

The School operates a zero-tolerance policy towards:

  • bullying;
  • harassment;
  • discrimination;
  • threatening behaviour;
  • abusive behaviour;
  • safeguarding breaches;
  • behaviour that places others at risk.

Brighton Ballet School reserves the right to remove any person from classes or premises where behaviour is considered inappropriate.

No refund will be provided in such circumstances.

17. DRESS CODE

Students are expected to wear the prescribed Brighton Ballet School uniform or approved dancewear as specified by Brighton Ballet School.

Exceptions may only be granted at the discretion of the Principal.

Jewellery must be removed before participating in classes.

Students wearing unsafe or unsuitable clothing may be refused participation without refund.

18. PHOTOGRAPHY AND VIDEO RECORDING

Separate consent will be sought for photography and video recording once you have registered for your class at Brighton Ballet School.

Images and recordings may be used for:

  • examinations;
  • educational purposes;
  • marketing;
  • social media;
  • website content;
  • promotional materials.

Consent may be withdrawn at any time in writing.

Withdrawal will apply only to future use and cannot affect materials already published.

19. EXAMINATIONS, SHOWS AND PERFORMANCES

Participation in examinations, demonstrations, performances, competitions, showcases, and shows is not guaranteed and remains at the discretion of Brighton Ballet School.

Additional fees may apply including, but not limited to:

  • examination fees;
  • costume fees;
  • theatre fees;
  • rehearsal fees;
  • photography fees;
  • performance-related expenses.

Such fees are generally non-refundable once committed on the student’s behalf.

20. SOCIAL MEDIA AND ELECTRONIC COMMUNICATIONS

Students, Parents, Guardians, and visitors must not publish content online that is abusive, defamatory, threatening, harassing, discriminatory, or likely to bring Brighton Ballet School, its staff, Students, or families into disrepute.

The School reserves the right to terminate enrolment where online behaviour significantly breaches this requirement.

21. CUSTOMER PROPERTY

Personal belongings are brought to classes entirely at the owner’s risk.

Brighton Ballet School accepts no responsibility for loss, theft, or damage to personal property unless caused directly by negligence.

22. CLASS CHANGES AND CANCELLATIONS

Brighton Ballet School reserves the right to:

  • change teachers;
  • change venues;
  • amend timetables;
  • combine classes;
  • alter class content;
  • cancel classes where necessary.

Where possible, reasonable notice will be provided.

No compensation shall be payable for changes made in good faith.

23. FORCE MAJEURE

Brighton Ballet School shall not be liable for any failure to perform obligations caused by circumstances beyond reasonable control, including:

  • severe weather;
  • pandemics;
  • epidemics;
  • government restrictions;
  • utility failures;
  • industrial disputes;
  • venue closures;
  • natural disasters.

Alternative arrangements, including online classes, venue changes, timetable amendments, recorded content, or rescheduled sessions, may be offered where reasonably practicable.

24. DATA PROTECTION

Personal data will be processed in accordance with UK GDPR and applicable data protection legislation.

Customers agree that Brighton Ballet School may contact them regarding:

  • enrolment;
  • safeguarding matters;
  • payment reminders;
  • timetable changes;
  • operational updates.

25. INTELLECTUAL PROPERTY

All course materials, photographs, branding, logos, website content, videos, and teaching resources remain the intellectual property of Brighton Ballet School.

No material may be copied, reproduced, distributed, or shared without prior written permission.

26. COMPLAINTS

Any complaint should be submitted in writing to:

info@brightonballetschool.co.uk

We aim to acknowledge complaints within 7 working days and respond fully within 28 days where reasonably practicable.

27. ENTIRE AGREEMENT

These Terms and Conditions, together with the Privacy Policy, Safeguarding Policy, Code of Conduct, Health & Safety Policies, General Risk Assessments and any booking confirmation, constitute the entire agreement between the Customer and Brighton Ballet School.

No verbal statement, representation, promise, or assurance shall form part of this agreement unless confirmed in writing.

28. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

29. ACCEPTANCE OF TERMS

By purchasing, enrolling, booking, attending, or permitting a child to attend any Brighton Ballet School activity, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions, together with the School’s:

  • Privacy Policy;
  • Safeguarding Policy;
  • Code of Conduct;
  • Health & Safety Policies;
  • General Risk Assessments;

as published and amended from time to time.
